By joining this webmaster affiliate program (“Affiliate Program”), you (“Affiliate” "You") are entering into a binding and enforceable contract with 713 Media, doing business as DigitalDope.com (“Company”; “We”). This Agreement sets forth the Terms and Conditions and program rules under which you may participate in the program. By participating in the program, you are affirmatively stating that you have read, understood and accept this Agreement and agree to be bound by all of the Terms and Conditions set forth below:
ALL AFFILIATES, CONTACTS, AND PAYESS MUST BE AT LEAST 18 YEARS OF AGE OR OLDER
All Affiliates, contacts and payees must have reached the age of majority under applicable law where they reside and/or do business. All Affiliates, contacts and payees must must be at least 18 years of age or older. You represent and warrant that you have reached the age of majority under the laws of the state or locality where you reside and/or do business.
ASSOSIATION WITH ILLEGAL ACTIVITES IS PROHIBITED
You may not promote our sites or our Affiliate Program on any site that endorses, promotes or features child pornography, bestiality, rape, violence, torture or any other illegal activity. This applies even if the activity is legal in your jurisdiction. No exceptions! This is something we will not tolerate and will report to the authorities.
FRAUDULENT ACTIVITIES
If you attempt to defraud our Affiliate Program by generating false or fraudulent hits or sign-ups, your account will be closed without notice and you will be prosecuted to the full extent of the law. We monitor all hits and sign-ups to ensure they are not generated falsely. If you signup to a paysite using your own linking code, we will consider your account to be fraud and you will not be paid at all. However, if you would like to make a "test sale," please notify us BEFORE the sale and we will accommodate your request. Otherwise ALL test sign ups will be considered fraud and we will terminate your account without notice.
MULTIPLE ACCOUNTS
You are not permitted to have multiple accounts unless you first get written permission from a representative of our Affiliate Program. This includes but it not limited to two webmasters using the same mailing address. You MUST contact us first, no exceptions!
TECHNOLOGY
While we aim to avoid technical problems, we are not responsible for any faults, delays or downtime that may affect the performance of our sites or our Affiliate Program. There will be no compensation for technical problems.
PAYMENTS
If you have chosen to participate in our percentage commission program, unless otherwise noted, you will be paid 50% of the membership revenue you generate for us. Membership revenue is defined as the total membership fees (initial fees and recurring) paid by visitors you send to our Affiliate Program.
INTERNATIONAL WEBMASTERS
We currently do not accept webmasters from Eastern Europe or various parts of Asia to participate in our program. If you live in Asia, please contact us first and accounts will be approved on a case by case basis. All funds are paid in US Dollars. No exceptions.
BULK E-MAIL / SPAM
At this time we do not accept ANY traffic that is unsolicited e-mail. The transmission of unsolicited bulk e-mail, including the transmission of counterfeit e-mail, may result in civil and criminal penalties against the sender under applicable federal and/or state law. In other words, don't even think about it.
TERMINATION
We reserve the right to terminate any account, at any time, if we believe these terms and conditions have been breached in any way. In such an event, all accrued funds will be forfeited. We also reserve the right to terminate any account for any other reason by giving the Advertiser seven (7) days notice. In such an event, all accrued funds will be paid. We reserve the right to cancel an account with an abnormal amount of charge backs and refunds. In such an event, all accrued funds may be forfeited.
MISCELLANEOUS
You must remove all our photos and videos, banners, graphics and logos from your site(s) and cease sending web traffic to our Affiliate Program within seven (7) days of this Agreement being terminated.
We do not accept webmasters using non adult free hosts such as geocities and others.
We reserve the right to cancel this program at any time, without prior notification. In such cases you will be notified immediately and paid for all accumulated funds up to that point in time, except in cases where it is determined you have cheated by violating this agreement in any way, you will not be paid.
We reserve the right to deny any prospective sponsor admittance into our program for any reason, based on the content of their website or for any other reason.
